1. Introduction

Ascendara is a free and open-source software project licensed under the Creative Commons Attribution-NonCommercial 1.0 Universal (CC BY-NC 1.0) license. By downloading or using Ascendara, you acknowledge and agree to the following terms.

1.1 Agreement to Terms

By using Ascendara, you agree to these Terms of Service and the Privacy Policy in the following ways:

• When you check the corresponding checkboxes during the application onboarding process
• Automatically when you download, clone, or fork the source code for building the application yourself
• When you use any of Ascendara's servers, features, or services

If you do not agree with these terms, you should not use Ascendara or its source code.

2. License

Ascendara is distributed under the CC BY-NC 1.0 Universal license. Users are free to:

• Share: Copy and redistribute the material in any medium or format.
• Adapt: Remix, transform, and build upon the material.

Restrictions:

• Non-Commercial Use Only: Ascendara or any derivative works may not be used for commercial purposes.
• Attribution: Proper credit must be given to Ascendara and tagoWorks.

3. Usage

Ascendara is accessible to users worldwide without restriction. As an open-source application, user access cannot be terminated by tagoWorks. However, users are prohibited from engaging in the following activities:

• Reverse-engineering or tampering with Ascendara's source code in violation of the license.
• Using Ascendara for unlawful or malicious purposes.

4. Updates

Users may choose whether Ascendara installs updates automatically or manually. It is the user's responsibility to ensure the application remains up to date for optimal performance.

5. Analytics

Ascendara provides an optional analytics service to help improve the software while maintaining user privacy. Analytics are disabled by default and require user consent during the initial setup.

Data Collection:

• Session Information: Includes app version, platform, browser details, screen resolution, session duration, and time zone.
• User Interactions: Includes page views, feature usage, UI interactions, and tutorial progress.
• Performance Metrics: Includes memory usage, navigation timing, network conditions, and error occurrences.

Data Retention:

• Analytical data is stored indefinitely on Ascendara's servers.
• If analytics are disabled, any pending data on the user's app will be deleted immediately. However, data already stored on Ascendara's servers cannot be deleted.

Privacy:

• No personally identifiable information is collected.
• Data is securely stored exclusively on Ascendara's servers and never shared with or sold to third parties.

6. Support

Support for Ascendara is available through the official tagoWorks Discord server. tagoWorks is not responsible for:

• Account losses, bans, or suspensions caused by third-party services or user actions.
• Any damages or losses resulting from the use of Ascendara.

7. Reports

Users can submit bug reports and provide feedback by:

• Right-clicking anywhere within the app.
• Reporting broken games through the game download screen.

All submitted reports are reviewed by tagoWorks to improve Ascendara.

8. Limitation of Liability

Ascendara is provided "as is," without any guarantees or warranties. tagoWorks is not liable for:

• Any damages resulting from the use or inability to use Ascendara.
• Loss of data, revenue, or business arising from the use of Ascendara.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which tagoWorks operates.
